The role you’ll contribute:
Strong regulatory background in anti-kickback, Stark, HIPAA, tax-exempt organization rules and regulations, fair market value and commercially reasonable concepts, and business organizations with an ability to draft and negotiate contracts, and provide legal advice on physician recruitment, employment, retention, compensation practices, affiliation agreements, professional service agreements, practice acquisitions and joint ventures matters, other business relationships, various types of leases including space leases and equipment leases, subpoenas, and garnishment issues. This individual will advise CEOs, executive management, compliance department, and medical staff leadership on a wide variety of health care and legal issues.

Stark Law and Anti-kickback statute and implementing regulations

Provider (physician and advanced practice practitioner) employment issues
Physician practice issues
Professional service agreements
Affiliation agreements
Due diligence
HIPAA
Peer review
Medical staff issues
Licensing
Informed consent
Various types of leases including space leases and equipment leases
Subpoenas
Garnishment issues
Legal aspects of patient care including informed consent, medical records and privacy issues, and patients' rights issues
Guidance on revenue cycle matters
Other health care provider requirements
Participates in supervising legal support staff, paralegals, and contract managers
Adheres to the Rules of Professional Conduct of the Florida Bar and other state bar associations of which he/she is a member
Promotes legal department efficiency by utilizing templates, forms, and instructional materials
The expertise and experiences you’ll need to succeed:
Graduate of an accredited law school
Graduate of a four-year accredited university
5-15 years health law practice experience
Law firm or relevant governmental experience, or health care legal experience
Member of Florida Bar Association or Authorized House Counsel in State of Florida
KNOWLEDGE AND SKILLS REQUIRED:
Ability to deliver a response to stakeholders succinctly
Excellent writing, communication and organizational skills
Excellent problem solving skills
Proficiency in legal research, including Lexis and other research tools
Knowledge of health care law, including principles of Medicare reimbursement programs, anti-fraud statutes and programs including the Medicare Fraud and Abuse (Anti-Kickback) Statute, Stark Law, False Claims Act, and Civil Monetary Penalty Act, HIPAA and their implementing regulations
Knowledge of federal and state tax law, real estate law, tort law, and contract law as those areas relate to health care law
Ability to work effectively with others as well as work independently, without close supervision
Familiarity with Microsoft’s office suite and other software applications
Preferred Qualifications:
Board certified in health law or board eligible.
